The Bankruptcy Process in Jacksonville
We will conduct an extensive interview with you to get a firm grasp of your situation. We know that no two people, circumstances or bankruptcies are the same. Therefore, it is our priority to evaluate each case individually to ensure that we are fully prepared. We will provide you with a detailed list of the documentation that we will need to prepare your petition. W e can also assist you in obtaining the pre-bankruptcy counseling required.
We do a thorough legal analysis of the issues of your case, including exemptions, validity of liens, and any factors that may affect your ability to obtain a discharge of debt. After determining with you the best option for your circumstances: Chapter 7, Chapter 13, etc., we will draft, review and file the bankruptcy petition. Chapter 7 is a much shorter process which normally takes a few months. Upon filing your petition, creditors can no longer contact you.
For Chapter 13, your creditors will be notified of the filing, at which point actions they are taking will cease. We will then prepare you for and attend a formal meeting of creditors with you as well as the confirmation hearing. At the confirmation hearing we make sure that all documentation required by the trustee to confirm your plan is correct.
The final step is a full case review. We will review your case to make sure you have satisfied all requirements necessary for discharge. At this point your remaining debt will be discharged. The Chapter 13 process normally takes three to five years to complete.
